He would be dead. The turtle's shell is actually an overgrowth of it's ribs. So, he'd be lost his ribs & would not be able to survive since it's a vital part of his body. The shell is not his domestic, it's part of his body so he'd be neither choice you gave.
Answers: That depends! was he renting, leasing or buying his shell? What was his mortgage rate on the shell? Did he sublease it to another critter? Was that permissible is his contract?
